1. Who you are contracting with

MyEpicDay ("the Service") is provided by Can Kurt ("we", "us"). These terms form an agreement between you and Can Kurt. Contact: support@myepicday.app.

2. Acceptance

By creating an account or continuing to use the Service you agree to these terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your country to enter into this agreement, or that you have the authority to bind the organisation you represent.

3. The Service

MyEpicDay lets you rate each day from 0.0 to 10.0 and optionally attach a written review, a voice review or a photo, and then review your history through calendar, progress and ranking views. A paid Pro subscription unlocks your full past archive, month-versus-month season comparison, unlimited voice and photo reviews and advanced statistics.

4. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Tell us promptly if you suspect unauthorised use.

5. Acceptable use

You must not misuse the Service. In particular you must not:

• use it for any unlawful purpose, or to store or distribute unlawful content;
• engage in fraud, spam or impersonation;
• upload content that infringes anyone's intellectual property or privacy rights;
• interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, circumventing technical limits, or scraping data;
• reverse engineer, resell or redistribute the Service.

6. Your content

Your entries, reviews, voice recordings and photos remain yours. You grant us a limited licence to host, store, process and display that content solely so that we can provide the Service to you. We do not publish your content or make it available to other users.

7. Intellectual property

We retain all rights in the Service itself, including its software, design, branding and documentation. Your subscription grants a limited, non-exclusive, non-transferable right to use the Service within the plan you selected.

8. Payments and subscriptions

Pro is offered at €4.99 per month or €39.99 per year, billed in advance and renewing automatically until cancelled. You can cancel at any time and keep access until the end of the period you already paid for. Switching between the monthly and yearly plan takes effect immediately and is billed prorated.

9. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Service levels and warranties

We work to keep MyEpicDay available and reliable, but we do not guarantee that the Service will be uninterrupted, timely or error-free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. MyEpicDay is a personal journalling and self-tracking tool and is not a medical device or a substitute for professional mental-health advice.

11. Liability

To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months before the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

12. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

13. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination your access ends and your data is deleted in line with our Privacy Notice; contact us beforehand if you would like an export of your entries.

14. Changes to these terms

We may update these terms as the Service develops. We will notify you of material changes in the app or by email before they take effect; continued use afterwards means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the seller's country of establishment, and the competent courts there have jurisdiction, without affecting any mandatory consumer protections available to you locally.
